Pink Span operates as an independent digital engineering collective providing website development, mobile app development, software development, game development, software testing, UI/UX design, cloud deployment, and technical support services.

2. Acceptance of Terms

By accessing our website or engaging our services, you confirm that you agree to these Terms and Conditions. If you do not agree, you should not use our services.

3. Services

Pink Span provides digital development and related technology services as agreed upon in written proposals, contracts, or service agreements.

Project scope, deliverables, timelines, and pricing will be clearly defined before work begins. Any additional work outside the agreed scope may require a separate agreement.

4. Client Responsibilities

Clients agree to:

• Provide accurate project requirements and necessary information.
• Deliver feedback, approvals, and content within agreed timelines.
• Ensure they have rights to all materials provided to us.

Delays in client communication or content delivery may affect project timelines.

5. Payments and Fees

• Payment terms will be defined in the project agreement.
• A deposit may be required before project initiation.
• Milestone-based payments may apply depending on project size.
• Final delivery may be subject to full payment clearance.
• Failure to complete payments may result in suspension of services.

6. Intellectual Property

• Upon full payment, the client will own the final approved deliverables, unless otherwise agreed in writing.
• Pink Span retains the right to showcase completed projects in its portfolio unless the client requests confidentiality in writing.
• Third-party tools, plugins, frameworks, or licensed software remain subject to their respective licenses.

7. Confidentiality

We respect client confidentiality. Any sensitive business information shared during the project will not be disclosed to third parties without consent, except where required by law.

8. Revisions and Changes

Reasonable revisions within the agreed project scope are included. Significant changes, additional features, or new requirements may require revised timelines and additional costs.

9. Limitation of Liability

Pink Span shall not be held responsible for:

• Indirect or consequential damages
• Business losses due to third-party services
• Delays caused by external providers (hosting, APIs, payment gateways, etc.)

Our total liability shall not exceed the amount paid for the specific project.

10. Third-Party Services

Projects may integrate third-party services such as hosting providers, payment gateways, or external APIs. Pink Span is not responsible for issues arising from those external services.

11. Termination

• Either party may terminate a project agreement in writing. Work completed up to the termination date must be paid for in full.
• Deposits are generally non-refundable unless otherwise stated in the agreement.

12. Maintenance and Support

Post-launch maintenance and support services are provided only if included in the agreement or purchased separately.

13. Changes to Terms

Pink Span reserves the right to update these Terms and Conditions at any time. Continued use of our services implies acceptance of any revisions.

14. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with applicable laws of the jurisdiction agreed upon in the service contract.
